MIXED PRIVATE GYNAECOLOGY-MATERNITY-SURGICAL HOSPITAL S.A.”, seated in Pylaia, Thessaloniki, Greece, (end of 17th Noemvri St. Tel: +30 2310-984000, info@genesishospital.gr) (hereinafter referred to as the “Company”).

The Terms & Conditions governing the use of the Website (hereinafter referred to as the “Terms & Conditions“) are set out in this document as well as in any other document referred to herein.

Before you start browsing the Website, please carefully read the Terms & Conditions, which describe your rights and obligations as well as our Privacy Policy. By using the Website, you agree that you explicitly and unconditionally accept and are bound by the Terms & Conditions and the Privacy Policy. 2/ Website Visitor/User Obligations:

2.1. All Website users are obliged to use it according to the applicable Terms & Conditions.

2.2. The users of the Website accept that they shall not use the Website to send, publish, email, or otherwise transmit any content that is illegal, harmful, threatening, offensive, harassing, defamatory, slandering, vulgar, obscene, libelous; infringes a third party’s privacy or confidentiality; shows prejudice or expresses racial, ethnic or other type of discrimination; may cause harm to minors in any way; is illegal to be transmitted in accordance with the law or contractual or administrative relations (e.g. inside information, proprietary and confidential information acquired or disclosed as part of an employment relationship or covered by confidentiality agreements); infringes any patent, trademark, trade secret, copyright or other proprietary rights; contains software viruses or any other code, files or programs designed to interrupt, cause damage, destroy or interfere with the operation of any computer software or hardware; intentionally or unintentionally violates the applicable Greek, EU and International Law and their provisions thereof; may harass third parties in any way and via any content used to collect or store other users’ personal data. In case a user does not comply with the Website’s Terms & Conditions above, the Company reserves the right to block their access to the Website and remove/delete all relevant posts and content.

2.3. The Website users accept that they shall not attempt any unauthorized access to the Website and its server, or to any other server, computer, and database connected to the Website, and they undertake the obligation not to attack the Website through a denial-of-service attack (DoS attack) or a distributed denial-of-service attack (DDoS attack). Breaching this obligation may constitute a criminal offence under the applicable law. Any such breach shall be immediately reported to the competent prosecuting authorities. Furthermore, in the event of such a breach, the Company shall immediately terminate the right of the user in question to access and use the Website.

3/ Intellectual Property Rights:

3.1. The entire content of the items posted on the Website, including but not limited to images, photographs, drawings, graphics, texts, available services, etc. constitute the intellectual property of the Company and are protected by the relevant provisions of the Greek and European Law as well as of international conventions. Any names, images, logos, and distinctive features representing the Company and/or third parties constitute exclusive trademarks and distinctive features of the Company and/or third parties, and are protected by the Greek, EU, and International Laws on trademark, industrial and intellectual property, and unfair competition.

3.2. It is strictly prohibited to any user of the Website to:

a/ amend, translate, create or attempt to create derivative work from or a copy of the software or the Website, either in whole or in part;

b/ decompile, disassemble, convert the object code into source code; and

c/ distribute, assign, share, lease, lend, sell, rent, or transfer in any other way the software or the Website for their benefit.

3.3. Under no circumstances and by no manner of means are users of the Website permitted to reproduce, redistribute, copy, reformat, amend, disclose, distribute, repost, download, display, screenshot, upload, or transmit any material available on the Website, or sell or assign the use of the Website, without prior express written consent of the Company.

4/ Limitation of obligations and liability:

4.1. The content of the Website is solely intended for information purposes. Its purpose is to provide information to the visitors – users of the Website about the provided services. Furthermore, it informs users on the latest news and on discounts applied as well as on any career opportunity with the “EUROMEDICA” Group.

4.2. The content of this Website may include typographic errors. The Company shall not be held liable for any typographic errors.

4.3. The Company shall not be held accountable to users, partners, and/or any entitled third party for any loss or damage (direct, indirect, consequential, financial, or any other kind) caused by:

b/ any technical problems or malfunctions of the Internet Service Providers;

d/ force majeure events; and

e/ breach of the applicable law (including but not limited to tax legislation, data protection legislation, etc.), related to the use of the Website.

4.4. The Company and its partners are in no way liable to users or third parties for any losses or damages of any kind, which are directly or indirectly related to the Website, its content, its services, or any of its applications or intellectual property rights, its delay in operation or transmission, or for any kind of malfunction.

4.5. No linked website is controlled by the Company. Therefore, the Company and/or its servants and/or its partners are not liable for their content, or for the links provided within the linked websites, or for any amendments or updates to such websites.

7/ Additional Terms & Conditions:

7.1. If any provision of these Terms & Conditions is deemed inapplicable, it shall be replaced by a new one, while the other provisions shall remain in full force and effect.

7.2. These Terms & Conditions were originally drafted in Greek and may be translated into other languages. In the event of a conflict between the translated version and the original Greek version, the Greek version shall prevail.

8/ Amendments to Terms & Conditions:

8.1. These Terms & Conditions, along with any other document expressly referred to therein, constitute the entire agreement between the Company and the users of the Website, superseding any prior written or verbal agreement, communication, or arrangement.

8.2. The Company reserves the right to unilaterally amend, renew, or terminate any term contained in the Terms & Conditions at any time and without prior notice to the users of the Website.
